Terms and Conditions

Mission:

NOVA Pride is a coalition-building organization with a mission to educate, advocate and celebrate in service to the Lesbian, Gay, Bisexual, Transgender, and Queer (LGBTQ) Community of Northern Virginia and its straight allies.

We aren’t just festivals and flag-waving. We are a movement to create an infrastructure between county-based organizations, charities, pride organizations, social groups, and the community at-large; to educate the community about LGBTQ issues, including health and discrimination; advocate for full LGBTQ equality; and celebrate diversity and individuality.

The NOVA Pride mission is not only a celebration of LGBTQ culture within the gay community, but also an effort to reach out and embrace our allies and the community-at-large, from youth issues (bullying, coming out) to elder issues and everything in between.

Application Rules and Regulations:

These rules and regulations form part of the Application and Agreement for participation in the 2016 Northern Virginia Pride Festival (the "Festival") between Fairfax Pride, Inc. d.b.a. NOVA Pride and the Festival Applicant ("Participant").

NOVA Pride retains the right to refuse any festival application without liability.  NOVA Pride retains the right to cancel events at any time, in part or in full, without liability.

The act of receiving a registration application shall not be deemed to impart or imply any obligation for NOVA Pride to accept any bid or application.  Upon approval of the application, the successful applicant will be notified via email of their acceptance and admission into the Festival.  

Payments must be received at least 7 days prior to the festival and within 30 days of registration application submission.  Registration will be considered incomplete and will be placed on hold if they are received without payment.  After 30 days, Applicant must resubmit their registration and forefeit any discounted rates of original application.

Festival Participants who breach any of the terms and conditions may be banned from participating in present or future NOVA Pride events.  Please note that the Festival is a "rain-or-shine" event.  NOVA Pride does not assume any liability for bad or inclement weather or other factors outside its control.  Refunds cannot and will not be made for any reason whatsoever.

All Applicants are deemed to have read and agreed to the following.  By completing the registration application and submitting it for consideration the Applicant agrees to abide by the Terms and Conditions listed below:

WHEREAS,

On behalf of and with authority of the business/organization/individual ("Entity") for which this application is made, applicant hereby declares that they acknowledge and specifically agree to the following:

Applicant is of the age of majority and has the authority to assume full responsibility for the behavior of all persons participating in the events falling under this application.  

Entity will comply with all applicable federal, state, and municipal laws and regulations in connection with the event.

Entity will operate in a manner consistent with pride, the celebration of diversity, and acceptance of the Lesbian, Gay, Bisexual, Transgender, Queer and Allied Community.

Entity supports the mission of NOVA Pride, and has no policy that discriminates against, or allows harassment of, any person employed seeking employment, membership, partnership, or volunteer status with the organization/business/individual on the basis of race, color, national origin, religion, sex, gender identity, physical or mental disability, medical condition, ancestry, marital status, age, sexual orientation, citizenship, or veteran status.

Placement of festival booths on the fairgrounds is determined according to many criteria.  NOVA Pride will make every effort to honor placement requests of Applicants, however placement is not guaranteed, and is the sole discretion of NOVA Pride, and may be reassigned as necessary through the start of the event.

NOVA Pride assumes no responsibility for damages to persons or property however caused, as a result of or pertaining to the participation and/or activities of the organization/business/individual in the Festival or other NOVA Pride events.  To the full extent permitted by law, NOVA Pride shall not in any manner or for any cause be liable or responsible for any Participant or for any other for any injury or damage to any person, business, or property in any way related to, or arising in connection with, the Festival.  Any and all claims for such injuries or damages are hereby waived and Applicant/Participant agrees to indemnify and hold harmless NOVA Pride, its Directors, Officers, Staff, Vendors, Volunteers, and Agents (the "Indemnified Parties") against any and all claims, liabilities, losses and expenses, including reasonable attorney's fees, imposed on, incurred by, or asserted against Indemnified Parties caused by an act or omission of Participant, or arising in connection with the activities conducted by the Participant in connection with the Festival.

No outside food or beverages are permitted on the fairgrounds without express permission by NOVA Pride prior to the day of the Festival.

Only Food Vendors may sell (or otherwise distribute) beverages, food, or food products of any kind.

Absolutely no controlled substances or outside alcoholic beverages are permitted on the fairgrounds for any reason, including the parking lots.

Entity must abide by the Rules of the Festival and all Terms and Conditions.

A failure to honor the mission and undertaking of the festival, or failure to comply with NOVA Pride's rules, could result in penalties, including exclusion from current and future events; or financial penalties.

Festival is a Rain-or-Shine event, and that there is no "rain date" should the Festival be cancelled or shortened due to inclement weather.  

Absolutely no refunds will be granted for any reason whatsoever.

Registration applications are not complete until payment in full is received; and that, once application and payment have both been received, absolutely no refunds will be granted for any reason whatsoever.

Entity meets the requirements for their registration category: 501(c)3 (IRS-recognized; includes places of worship and schools), Not for Profit (non-501c3; includes social and political organizations), Small for-Profit (less than $5M in annual revenue), and Large for-Profit ($5M or more in annual revenue).  If requested by NOVA Pride, participant must provide proof of eligibility.  NOVA Pride reserves the right to deny an application on the grounds of ineligibility or offer the applicant the opportunity to reapply under the appropriate category with payment of appropriate fees.

Any breach of contract, failure to comply with NOVA Pride's policies, terms or conditions may result in, and automatically grants NOVA Pride and its authorized agents the authority to implement, one or more of the following consequences:

  • Immediate termination of Participant registration agreement.
  • Denial of permission to participate in Festival.
  • Immediate ceasing of Participant operations.
  • Immediate removal from Festival grounds.
  • Forfeiture of any and all fees.
  • Assigning of Financial Penalties.
  • Exclusion from participation in Future Events.
  • Application of criminal charges.
  • Take legal action to recover monetary costs related to actions by the Participant, including damage to property, court fines, and fees resulting from lawsuits or charges against NOVA Pride.

NOVA Pride reserves the right to move or prohibit display of any signage, article, or product that, in its opinion, is not in alignment with the nature and character of the Festival, or not in harmony with other booth spaces.

No Participant shall operate amplification equipment or voice or audio reproducing machines of any type.  NOVA Pride reserves the right to require the immediate removal of any such equipment.

Booth spaces must be staffed and operated in a professional and courteous manner at all times.  NOVA Pride reserves the sole right to determine compliance with this provision, and has the right to order the immediate cessation of any activity in violation of this requirement.
